NOTIFICATION AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT PURSUANT TO THE DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA).

eQixen will respond to claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) or any applicable worldwide trademark or patent laws or any other applicable worldwide law. The DMCA provides a process for a copyright owner to notify an online service provider of an alleged copyright, trademark or patent infringement. When a valid DMCA notice is received, the service provider responds under that process by removing the offending content. We remove content in accordance with the DMCA and take rigorous measures to contact the owner of the removed content so that a counter-notification can be filed. Upon receipt of a counter-notification, we generally reinstate the content in question, except when we receive notice from a notification provider that legal action has been taken seeking a court order to restrain the alleged infringer from engaging in infringing activity. eQixen may provide copies of such notices to the parties to the dispute or any other third party in our discretion and in accordance with the law. eQixen's privacy policy does not protect the information provided in such notices.

Our policy is to respond to notices of alleged infringement that comply with the DMCA or any applicable worldwide trademark or patent laws or other applicable law, and to terminate the account of repeat or non-repeat infringers. Uploading any copyrighted material to the Site without the express permission of the copyright holder is prohibited by both criminal and civil law in many jurisdictions. Do not attempt to use underhanded tactics or provide downloads that provide anything malicious, not limited to, but not limited to, Spyware, Adware, Warez, Viruses, Trojans, etc. Such tactics will result in your account being banned if notified to us and in the notification of the appropriate authorities. Check uploaded files for viruses BEFORE uploading them by scanning them for free at virustotal.com.

If you believe in good faith that any copyright in your work has been infringed on the Site, or that any intellectual property rights have been infringed or otherwise violated, please notify eQixen's agent for notice of claims of copyright or other intellectual property infringement.

NOTE: THE FOLLOWING INFORMATION IS PROVIDED SOLELY FOR NOTIFYING EQIXEN THAT YOUR COPYRIGHTED MATERIAL MAY HAVE BEEN INFRINGED. ALL OTHER INQUIRIES, SUCH AS TECHNICAL SUPPORT REQUESTS, EMAIL ABUSE REPORTS, AND PIRACY REPORTS, WILL NOT RECEIVE A RESPONSE THROUGH THIS PROCESS.

If your content has not been posted on any eQixen website previously, your notice must include the following information:

2. Our website contains a description of the location of the material that you claim is infringing;

3. Information reasonably sufficient to permit eQixen to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted;

4. A statement by you that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law; and

5. A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

6. Identify the material on the Site that you claim is infringing, with sufficient detail so that it may be located on the Site;

Upon receipt of a written Notice to our email inbox containing the information described in items 1 through 6 above:

eQixen will remove or disable access to the material that is claimed to be infringing;

Account Termination

eQixen may, under appropriate circumstances, terminate the account of its users or subscribers if they are repeat infringers. If you believe that an account holder or subscriber is a repeat infringer on our website, please follow the instructions above to contact eQixen's DMCA Agent and provide sufficient information so that we can investigate the matter.
